The publisher reserves the right to reject or cancel any advertisement published or accepted previously. ELLA CREATIVE MEDIA will accept no advertising that is racially or sexually discriminatory nor advertising that is deceiving or fraudulent. The advertiser and/ or his agent agree to assume all liability for the content of ads printed. They must be fully authorized to use the ad’s content, including, but not limited to, persons’ names, pictures, testimonials, and any copyrighted or trademarked material (i.e., logo, etc.). Submission of advertising materials constitutes an agreement by the advertiser and/or agent to indemnify and hold harmless ELLA CREATIVE MEDIA and ELLA Inspires Magazine against any resulting loss, liability, damage, and/or expense of whatever nature. If an advertiser reserves space but fails to send new artwork by the materials deadline, ELLA CREATIVE MEDIA may run the most recently published ad or an ELLA CREATIVE MEDIA ad in its place at the advertiser’s cost.

You must be at least eighteen years of age to use Our website. Use of this website is at Your own risk. We host Our site on a reputable platform and take reasonable efforts to maintain and host the site. However, We make no explicit representations or warranties as to the safety of Your individual use of the website. The Terms and Conditions contained on this page are subject to change at any time.

TERMS​ ​

Cancellations

Cancellation after the ad's due date results in a full charge for confirmed space.

Confirmation of Receipt

Confirmation of receipt will be emailed for all space reservations and artwork submissions. You will also receive login information to the ELLA portal. If no confirmation or portal password is received within 48 hours, contact [email protected].

General Rate Policy

Advertisers are protected at the contracted rate for the duration of the contract. If the contract is cancelled before the fulfillment of the contract, they will be billed for one of the remaining ads on the contract.

Layout Design

Ads are full-color and include ad design by our staff at no additional charge. Once your files are submitted, we create a unique design for your review. We allow for 1 free design revision. Doing so ensures you’re part of the process, even if you don’t have an ad designed by a graphic artist already. If you do not like any of the designs provided, you may request a custom design priced at $500 per design.

Ownership of Photos and Ad Designs

Client agrees that subject to the rights and licenses granted herein, ELLA CREATIVE MEDIA LLC is the non-exclusive owner of the right, title, and interest throughout the world to all photos and any copies of the photos. Except as expressly provided in this Agreement, ELLA CREATIVE MEDIA LLC reserves all rights and licenses not expressly granted in this Agreement.

Restrictions on Use of Media

The client will not use the Ad designs or cover image for any of the following purposes:

(A) No Unlawful Use. The client will not use the ad designs or cover images in other publications, display advertisements (public kiosk, etc.), or any other place for marketing not associated with ELLA CREATIVE MEDIA LLC.

(B) No Products for Resale. Client will not use the Photos in any goods or products where the Photos are the primary value.

Deadlines

Each issue observes strict deadlines for production. Advertisers will be notified of what these dates are well in advance. If an advertiser is unable to furnish the publisher with the necessary collateral (files, images, logos, etc) on time, their ad will be suspended from the current issue and will instead appear in the next issue. This is non-negotiable.

Submitting Image Files

Logo and Image Files

Logos (PNG only) must have translucent backgrounds ONLY. No JPEG files please. Every image submitted should be at least 300 dpi to ensure clear printing in our print copies.

Advertising Materials

Advertising Materials (photos, etc.) requested for each insertion must be received before the space reservation closing date. Cancellations are not accepted after this agreement is signed. All contracted cancellations are subject to a penalty of one placement billing and must be canceled 30 days before the space reservation closing date.

INTELLECTUAL PROPERTY NOTICE

All images, text, designs, graphics, trademarks, and service marks are owned by and property of Company, or the properly attributed party. It is a violation of federal law to use any of Our intellectual property in whole or in part, and modification of any materials contained on this site is illegal and may be prosecuted to the fullest extent permissible should We choose to do so, including asking for financial penalties (damages) and/or an injunction forcing You to stop using Our intellectual property immediately.

You may NOT use Our intellectual property in any way, which includes republishing any text, image, design, or other property on another website, or posting a quote or image from Our site to any third-party website including social media. We have spent a great deal of time and money building the intellectual property located on this site and in order to maintain the integrity of it, We cannot allow any third party use.

YOUR​ ​MATERIALS​ ​AND​ ​CONTRIBUTIONS
